A professional organization sent a letter to a public body alleging me I was "unethical". I didnt noticed that until my employer asked me for clarification.


Is my human rights being violated?

The allegations is totally wrong, do I have the rights to defend myself?

Can this case be presented to and admitted by equal opportunities commission?

any laws I can apply?

any case precedent i can cite?

Check out the Personal Data (Privacy) Ordinance. Not familiar with the detail, but, in the UK, there are rules regulating to whom personal data can be disclosed and the need for such data to be accurate. There are remedies available through the Privacy Commissioner which include the right to have inaccurate personal data corrected. There is a right to see copies of personal data and this might be your first port of call. Subject to certain exceptions, you are entltled to see all personal data kept about you - this would include information from third parties and between members of your professional body. In short, you are entiltled to see your file. I suggest that you contact the office of the Privacy Commissioner - they can probably give you better advice than I can. There, of course, other possibilities such as an action for defamation, negligent mis-statement or malicious falsehood, but these are very expensive. So, go to the Privacy Commissioner first.
