I've been on holiday/vacation over the last few weeks and missed both the days off due to the typhoon as I was out of HK. Under HK employment law - do I still have to use my vacation days for those days I took off?

That is a little silly don't you think, you take leave, If you find out later whilst you are abroad or you are even in Hong Kong for that matter, that there is a typhoon and offices are shut anyway, you cannot seriously expect your work to compensate you for the fact that for the rest of your colleagues it is neither safe nor in some cases are they able to make it into work. Its really just tough luck and that is the way it goes, its not a public holiday and should not be treated like one. Ultimately your colleagues are on call during typhoons, if the storm signal were to have come down during working hours, they are expected to come into work, you are not, you are on leave. The fact that the signal stayed up is neither here nor there. Its bad luck you missed out on a day off, but that is life.

How old are you?! I assume you must be new to the world of work. Only school kids get the "day off" and the rest of us adults are supposed to work from home. You were clearly on holiday so really that is a ludicrious request.

Come on Lime, surely I'm not the only person in HK who regards the typhoon days as "days off" and looks forward to them (provided no one gets hurt...) ! Also, not all of us have jobs where we are in the position to "work from home"

It is not a day off it is a safety precaution to keep people off the street and get them indoors. I really can't believe someone would even contemplate asking taht question. Its like being sick for a day when on vacation. Do you ask the boss to compensate you one more day off because you were sick and couldn't enjoy you vacation?

Actually - my job does just that... you provide your medical certificate and you can trade your holidays for sick days.
Wouldn't work for a typhoon day though!

So your employer lets you take leave, and if you fall ill during that leave, you get additional leave to compensate you for the fact that you did not enjoy your holiday properly. That is a very liberal employer and far from the average. Personally I think that is nutty, just my opinion though.

A few years ago I was flying back into HKG from BKK when the flight was delayed for 24 hours by a typhoon. I was due to start work the next day, but obviously flew back that day, so lost an extra day's annual leave. Didn't seem fair, but that's life.

Hellokittyhk - my contract is the same. If I am sick while on leave then I claim a sick day for that day and cancel that leave day (I always provide a doctors note but not sure if one is needed). Seems a fair policy to me.

Not to me, If I was your employer, I'd be saying tough ti**ies you got sick whilst you were on holiday that's life, not my problem if you didn't enjoy your holiday when you decided you wanted to take it. Seems a little silly if you ask me, Personally I don't think your work should bear responsibility for whether you are unable to enjoy your holiday due to illness
I am an Investment Banker with 15 years experience and manage the line that I work on with an A list bank, and though I get a lot of benefits, that is not one I get, and If I went to my boss with something like that, I am not sure it would do my career much good. I could probably negotiate it in, but I wouldn't be impressed with juniors who came to me with that notion and its not something I would do either myself.

So you can go to Bali for a five day holiday. Last day go to a local doctor and give him some money to write you a sick note saying you were sick for the whole five days. Get back to work and tell the boss you were sick and get your five days leave back???? That is a perk even the civil servants don't get.
