Can anyone tell me if there are any laws in Hong Kong regarding teachers and pupils smoking in the immediate vicinity of the school building? Thanks

Once they are out of the school grounds they are free to do as they wish. There are no laws against it at all.

That may be the law, but if the school puts it in their contracts and admissions policy that teachers or students may not smoke in the immediate vicinity, then as long as immediate vicinity was defined both teachers and student would have to oblige. I cannot see a school being too happy if a teacher or student was standing right outside the school gates and lit up a fag as soon as the school bell rung. I am sure after all this time they will have contingency for that.

Well, Digital Blonde, the international secondary school my daughter attends does not, as far as I know, have any such policy. Students, teachers and other staff members do indeed light up as soon as they step off what is strictly the school premises. Teachers just go and sit on the adjacent (public) steps and smoke. The kids do it as well, but I find it more shocking that it's tolerated from the teachers (as one would think that the school authorities would want them to set an example). However, if there is no legislation, then I don't see this particular school taking a stand on this issue.

Shocking indeed the education department and Smoke Free HK http://www.smokefree.hk/cosh/ccs/index.xml?lang=en should get onto the government with an amendment to the schools for a hundred or two hundred meter perimeter no smoking zone. I look forward to July 1, 2009 when they(supposedly) will stop smoking in pubs & clubs

Try raising it through the PTA, I doubt very much other parents are going to be to happy that the school allows teachers to smoke in plain view during or immediately after school hours, or has no jurisdiction over students who are of legal age that choose to do so as well. It is not unreasonable to expect both teachers and students to be discreet and it is something that can be easily changed. I would raise it through the PTA. If enough parents kick up a stink I am sure the school will start including it in their contracts for both admission and employment.
