Working in HK: is this legal?

I currently live in England. I would like to take up a role as a contractor/consultant for several months in Hong Kong. A local HK company has offered me the contract.


I don't have my own company. Can I incorporate a company outside Hong Kong (e.g. in UK, or another offshore location), and accept the contract in Hong Kong? What is the best way to arrange this? How long can I do this for?

Does it matter where I am paid? e.g. if i get paid into my UK bank account, presumably I have to pay UK tax...and wouldn't I have to register as self-employed or something back in England?

First thing, with a UK passport you get 6 months as a tourist here, not 3 months.


Second thing, as you do not have a work visa here you will be unable to pay HK income tax. You are not supposed to be working here at all, although trips for "business" are allowed. So your tax situation will be with UK not HK.

I was a self employed consultant which conducted a three month contract in Dubai for a HK registered company.

I was based in Dubai, but travelled to and from HK every two weeks

Upon completion of my contract I returned to the UK, as an ordinary resident I had to declare this tax free income and as such paid income tax on the amount.

If you are ordinary resident of the UK then whatever you earn outside of the UK is taxable unless you declare your self a non ordinary resident.

To become a non ordinary resident you must spend no more than 180 days in the UK in one year.


I suggest you speak to a UK tax expert, as the HMRC will want their share.
