Returning back to UK, Asian Wife, Economically Insolvent

Hope some one can advise.

Having thrown everything at my business to weather the current downturn, I've more or less lost everything after a major business deal fell through - hence, no cash now to maintain either office or family home.

I'm a UK national with permanent residency, my wife is Asian, a permanent resident and full - time house wife.

We have one child under two with full UK Passport.

Given no welfare assistance in HK, its necessary to leave ASAP to guarantee at least food and shelter for the child - my family will pay to fly us out and house us whilst I get back on my feet again.

My problem, if I go by the book and get the wife to apply for permanent spousal resettlement in the UK from Hong Kong, this not only will cost, but means both of us have to remain here until UK visa section makes a decision - now most unlikely given I'm reliant on my own family to support us in the UK.

My wife currently has 10 months left on her current UK entry Visa.

Hence, is it possible for us to go to the UK and apply for my wife to settle there once we are back safely with the folks and earn some breathing space - this also gives me a chance at least to get work to support us.

Whilst I'd like to do everything legitimately and by the book, given my present circumstances and threat of legal action by the Landlord, we'll be homeless within a month.

Any advice welcome as now completely at my wits ends - and UK consulate not handy in giving out advice.

Dadda has the right idea. Get there first and take it from there. Won`t be easy and there won`t be any benifits for her but you can claim or get some work there first.

Go to the UK on the given visa. Show that you are married (certificate). Depends where you are married though. I've read somewhere that even if you got married in HK it doesn't mean that you are married in the UK (B.S right). At least you can stay with family in the U.K, this will certainly buy time. With your situation depending if you find work or not, you can extend your wifes visa. Even if you don't find work within the given time, you just need proof that you are looking for work. Remember to keep track of your records with your local employment agency. Sign on! and best of luck.

Many thanks for the feedback off all those that posted, seems the best advice is to go back to the UK and try and sort matters out from there - given its the child one worries about, and she's a UK citizen, it seems unfair that the mother is put through so many hoops and loops.

Still, growing unemployment in the UK is also an issue - still, not too many options available presently
