Break lease - what happens with the deposit?

I have a one plus one year contract with a break lease clause. I'm currently in the second year of the lease (14+ months) and i need to leave Hong Kong. I paid two months deposit upon moving in.


My question is as follows: am i entitled to get the deposit back after the 60days notice period? I understand that the land lord might make deductions for wear and tear and stamp duty etc. But i should be able to get most of the deposit back right?!

Under normal circumstances, you will definitely get your 2 months' deposit back. Do give enough notice as a friendly gesture to your land-lord and tell her/him when you are actually moving out and upon clearance, arrange a date and time to meet at the empty flat and return the keys & view/tour around the flat to confirm everything are back to it's originality except the normal wear & tear which doesn't cause for claims nor apply to any deduction from your deposit. In return, he/she will give you a cheque for the 2 months' deposit and that sort of wind up the whole deal. That's how a good tenant/land-lord's relationship should be!

If yours is one + one, then you can get the deposit back. But of course need to see what terms you actual signed.

Regular 'Wear and Tear" is accepted everywhere.

Every 1+1 contract stands for a minimum stay of 14months.

12 months for the first year + 2 months notice.

Once you've served let say 15months and you would like to leave, you'll have to advise your landlord immediately and you'll be able to leave and get your deposit back after 2 months with a total of 17 months.
