Hi, I would like to hear from anyone who has drawn up a last will and testiment in Hong Kong and who has children. I am particularly interested in families whose home country is not HK but who are living in HK presently. I have been told it is especially important to name guardians for your children should anything happen otherwise they become wards of the State and they will not be allowed out of Hong Kong (even with immediate family members) until everything has been settled in court with regards to guardianship. So, what needs to be done? Can we simply state in our will who we would like to look after the children or is there a seperate legal document that needs to be filled out? Can anyone reccommend a lawyer / company that they have used? Any advice is much appreciated. Thanks in advance.

We have done this. Our daughters are citizens of two countries and we are citizens of one of those. Making up a will is very important in order to ensure who gets the kids in the short term.
As you say, you should specify guardianship or the state will decide both short- and long-term who gets the kids. National law of the country of citizenship also applies long term.

Just needs to be spelled out in the will.
