I signed a contract on my current flat and moved in Aug 10 2008 - I have the option of moving out after 12 months by giving one months notice which is what I wish to do.
Hence, I will have to pay rent until Sept 9?!
Is it normal to ask not to pay the last 2 months rent and for landlord to take it from the 2mnth deposit??
Just wondering what's the norm here.

I am looking to move out of HK.
Is it legal to just not pay your last 2 months and assume the landlord will be ok to use the deposit, or best to simply inform the agency of my intensions at least??

Inform them of your intentions. Don't just not pay the rent or else you could find yourself with a summons.

tell your landlord clearly that you are leaving HK. he may agree to use your one month deposit as a rent for last month & he may keep 1 month deposit as a lieu whether there is any damage to repair + wather & electricity charge which you recently used & bill not yet arrived.
You signed the contract on August 08. that means you have start paying rent from August 08. if so, than you no need to pay rent for Sep 09. i mean you just have to pay rent until July 09.
