Company will not release Resignation Certificate.

Hi

Thank you for reading this first of all.

I Left my old company in March.. although i did not leave via giving my notice (I just had enough) which was due to my son (Baby) becoming sick, i left China for a month and returned.

Once returned i found and accepted a new job offer, however my new company needs the Resignation certificate from my previous company so they can apply for my new visa as my old one expires on the 1st July 2009.

But despite many emails and eventually calls they old company are not issuing this document no reason to date has been given just a 1001 excusses.


So my question is what can i do if they do not issue the document, is there a way to overcome this issue when applying for my new work visa.

Your former employer is under no obligation to provide you with this. Normally, it is provided as a courtesy for exiting employees because it speeds the work permit transfer process up. It is not a major issue as your new employer would need to apply for a fresh work permit for you in any case, it just means they will need to pay slightly more to a visa agent and the process will take longer. For future reference if you are faced with this again, I suggest you get your new employer to contact your old employer and request this as a professional courtesy, you are likely to have a better response than contacting them yourself.
