Clause on Liability

We're in the midst of negotiating with a hotel for a conference. In the contract drafted by the hotel there are clearly defined terms of cancellation policy against us. When we asked them to put in a similar clause holding the hotel responsible in the event the hotel has to cancel on us, it refused to do so. It has so far also ignored our request for a copy or statement to certify that the hotel carries proper third-party liability coverage.


My question is this: is this a common practice in HK? In the US, we routinely put in such clauses. Would appreciate any comments.

You will find that it is highly unlikely that they, as a large corporation, would amend the terms of the contract which are highly standardized. Hotels are not likely to provide specific information re details of their insurance (third-liability coverage or otherwise). Therefore the best advice might be to try to negotiate with other hotels which are more flexible to these requests.

nonsense - all larger companies carry such insurance, it is a requirement of business. They are liable in any event for any cancellation on their part, save as to force majure/acts of god.
