I need an advice pls....I was an ex domestic helper in HK. i terminate my contract due to health problem and personal transaction need to be done back home. I am new in HK, my co helper in the house ask me to loan from the bank under my name and she will get the money. Yes, maybe i am really dumb. but we wake up every morning, telling me to help her and give her a favor. for a month of keep asking me, i said yes. when, i am still there in HK, she paid regularly. but when i left in HK, she didnt pay anymore. The bank sending me letters of demand to pay it. but i dont have job yet. the woman, is not responding on my text or email. any advice pls....thanks...

Too bad for you bunny. Your side of the story might be true, but in the lender's eyes you borrowed the money. It doesn't matter that it was not you who benefited from it, you're still responsible for it. It's so easy for your ex-co-worker to deny.

U need to prove liability, but the EGIB will contact them directly to explain that they are still liable and enforcement will be made.

Hold your horses kumander, the OP's handle is 'bunny'pancake. Hopefully your info can help her. If not, bunny is in her ex-co-workers mercy in the sense that the she can get out of this mess if the "real" borrower pays up.
I'm no lawyer but between black and white docs where bunny signed in the dotted lines as the borrower and her claims that it was not really her who "used" the funds, the black and white documents will matter more.

Bunny, the small claims tribunal is a tribunal, a court but where no lawyers are present to represent/help the accuser and the accused. It is a very good provision in law where people can resolve their monetary problems "cheaply". So if you owe somebody money and you're not paying, the lender can sue you in the small claims tribunal to recover his money.
But as you can see, in your case, the lender did not go to the SCT maybe because they know that rulings there is quite difficult to enforce (make no mistake about it, it can be enforced). The lender is taking another route to recoup its money. They're quite effective in this regard. Case in point is your case, you're having problems and being pressured to repay. I suggest you followup on the suggestion given above by kumander, it might be of help to lessen the hassle brought by professional collectors.
I see your case as this: Transaction #1 is between you and the bank. You borrowed from the bank so you need to repay the bank. Transaction #2 is you lent money to your ex-coworker. You can chase after your ex-coworker just like how the bank is chasing after you now. As mentioned, usually banks are more effective in collection.
