changing a tenancy agreement

I signed a ta for 2 years - starting August 2009, but was unable to move to hk due to visa problems which have now been sorted out. I have paid the deposit etc. My employer is now offering me another contract for 1 year (not the original 2 year one), so I would like the ta changed to reflect this - 1 year from August. My landlady says that all ta agreements are for a minimum of 14 months - is this so?

Hi Cornnn. Most HK tenancy agreements will require you to serve out a minimum 12 months and give 2 months notice if you wish to leave after that. So yes, minimum 14 months. These details should all be spelled out in your tenancy agreement.

As far as changing the document goes, you'll need to get the landlord to agree. If you can think of a reason why it would be good for them to do this, then you'll have something to discuss with them, otherwise there's simply no incentive for them to do so.

Your best bet is to just talk to them about it. Don't demand changes, just be nice, and don't make them angry. It's entirely up to them.

min 14 months is not true. many are, but it's entirely negotiable in my view (i used to have a 12 month one)

Yes Cookie, you can negotiate almost any term on your tenancy, but this needs to be done before you sign the agreement.
