Relieving from service

Hi,

I have resigned in my current company last month.They are saying that I can not leave in three months as per agreement, but there is a clause stating that I can pay for notice period that i can not serve.


I requested them that for buying notice period still they are denying.


Please suggest what to do?

I cannot stay here... as i will lost my other job...

But what if they didn't give me a relieving letter ?

I need it before joining other company?

Its a letter company gives us when we are separating from company.


It is mandatory for my next employment.


It is a proof which shows there are no dues on you.

i have never received a relieving letter in my life...actually i don't even know what it is and i have still left companies.

I recently was asked to give one of our employees in China a letter of termination - it is required in some countries.


ksbhagwat - tell your new company that your current/old company refuses to give it to you.


And yes, if your contract states that you are required to give 3 months notice or payment in lieu then you can pay the company the equivalent of the 3 months you would have been paid if you stayed there. If it does not state anything about payment in leiu of notice then unfortunately you are obliged to work the full three months notice.

The terms and conditions stated in your Employment Letter shall be overridden by Employment Ordinance. You can dial 1823 ( HKSAR Goverment Hotline) for help.

Think it is a letter of release. Talk with the new firm and explain, presumably they will be reasonable if you make fair attempts to get released and the other firm refuses.


Even in HK not uncommon to require letter of release, e.g. HK Imm Dept needs it to change employers - otherwise how do you know someone is not merely on holidays? (there was a great example once I heard, hilarious, some guy worked for months at a new job then went back to the old job in a govt dept overseeing this firm, having seen all the files and knew where all the weaknesses were).
