i was told that prc laws don't require businesses to have workers comp insurance or any other kind of ins of that kind. so if a case were filed there is no incentive to settle.
anyhow, i sustained an injury to my back while at work. i have 2 herniated disks. i have a CT scan and drs diagnosis to prove it. i guess the real snag in pursuing compensation will come when my legal work status comes into question. i was hired by the school as an ESL/EFL teacher and I have a signed, chopped and/or witnessed contract showing they promised me a residence permit for the purpose of employment which they never followed through with. thats just one of many broken contractual promises. when i reported the injury and presented drs notes & x-rays they were quick to say "don't let the door hit you in the a** on the way out"
i am about to undergo expensive treatment and/or surgery and would like to make them pay for it or whatever else like "lost wages" "emotional/mental distress (hostile work environment) unsafe work conditions and breech of contract

There are certain insurances that are mandatory in China, but only if you are on a valid visa and contract.
The problem you'll walk into is that you shouldn't be working at all until you have your Alien Employment Permit. It's all very well saying that they should be responsible however you also have a responsibility to be working legally. I'm afraid you don't really have a leg to stand on in this case. Harsh it may seem but a reality in China.

the school has me "on the record" as a participant in their "cultural exchange program". meaning (according to them) i am not gainfully employed. can i attack it from that angle?
