Won a price and take it off letter

Dear all,

this week we receive an email from a Hotel were we pass the new year eve party saying that we won a trip to Australia for 2 persons.

After I call the Hotel and they confirm that we won a flight ticket for two persons to Australia.

We were very happy untli today when we receive a call and they inform that another person won the price before and by mistake from them they gave to us.

Now they are offering a dinner to compensate us.

The flight tickets were arround 12.000 HK$ and the dinner I supose can be arround 1000HK$.

I want to know if somebody can advice me what I can do legally.

I really want the trip as it makes us a lot of ilusion and we dont feel well with the dinner.

there is nothing you can do, unless you can prove damages caused by the rescinded offer. what was promised to you was a pure gift. in legal terms I believe it is called a unilateral contract. in other words, the hotel (the offeror) unilaterally offered you a gift without asking you to do anything in return. in such situations, the offeror can unilaterally rescind the offer. you the offeree, can however claim for damages if the offer was relied upon, and caused provable damages. For example, if you had "relied upon" the offer, and made other arrangements which you cannot terminate without cost. technically you can ask the hotel to pay for such costs. However, I doubt it will be worth your time to go through the process even if you do have such damages.
