Hi! We're renting out our place and I'm not that happy with the agent we've appointed as our "sole agent". Does anyone know whether or not the 'sole agency agreement' is a legally binding document? I've been told no, but just want to check!!!!

Surely it depends on the contract you have signed as to whether it is binding or not and for how long. I would be checking the terms.

[UPDATE] Please note that fee quotes stated in historic postings may be out-of-date.


All depends on the exact wording of the contract entered between you and the agent.....a label "Sole Agency" is not the sole determining factor on what the contract actually says and the rights of the parties thereunder....the bottom line is "get the contract in front of a lawyer"....he/she should be able to tell you the ups and downs within 15 minutes...
