Dependant Visa Query

I lived in HK with a dependant visa as my husband is a Perm Res. Card holder.


We moved to Britain some time ago but are likely to come back in the nxt 6 months.


My question is, I will be abe to enter HK using my HK ID Card as my dependant visa is valid until 2011, but can I renew my visa for another 3 yr one then get my perm resident status (after 7yrs) or do I start from scratch (another 1yr visa, then 3+3yrs)???


I actually put this to the immigration dept before leaving HK as I knew we would return and they wern't definitive in their answer.


Has anyone had experience of this?

You should be able to enter HK using your ID card as your visa is still valid, however your time out of HK will mean that the clock is essentially reset to 0 in regard to time spent towards permanent residence.

Just annoying that the immigration official I asked didn't give me a straight answer...in fact he said I might get a continuation towards my PR just depends on the day & the official!!!

By the way. Just to clarify. If you are away from HK for more than 32 months and you lose your permanent residency, the former permanent resident can still live and work in HK. It just means that if you are not a permanent resident, the government can deport you if you are sentenced to prison for more than 5 years. At least, that's my understanding. Not sure how this works with dependent visas.

Thanks for all the replies.


I know about my husbands PR status and that he has to reenter HK before his 3 yrs absence, but it just got confusing when it came to how long I could be away for with my current 3yr dependant visa.


I actually went to immigration to ask about this but wasn't given a straight answer as to whether I could be away for over a yr and still get another 3 yr visa towards gaining my PR status. It wouldn't normlly matter but just that I know we shall both return to live/work in HK before my husbands absence reaches 3yrs.


I just thought maybe someone has been in a similar situation and could tell me if they got another 3yr visa or were awarded a 1yr dependant one from scratch.
