Traffic Offense (Speeding)

I just received a Notice of Intended Prosecution for "Careless Driving".

The letter says I was driving at 78kph (82 reduced to 78) in an 70 zone..

There is no mention of any points or fixed penalty so I tried to look it up.


Penalties for speeding seem to start at 15 kph over the speed limit and carry 3 points, whereas Careless Driving is 5 points.. I don t really understand how an 8kph excess can be considered Careless Driving.


Has anyone else had a similar problem?

It's definately just a speeding ticket? You didn't run a red light or anything...?


Usually, those notices don't mention the points and fixed penalty - the first letter tells you of the intended prosecution, and the second letter will tell you what the penalty charge is and how to pay (or you can contest it in court). The second letter also doesn't mention points lost - sometimes that's included on a little handout that they put with the letter.


So you'll be getting a second letter in the next couple of weeks - hopefully that clarifies the situation. I know the second letter has a number on it of a police officer that's following your case, so you can easily call someone. Maybe there's a number on the first letter as well - can't remember.

Thanks Slammy, there is a number. I will call but just wanted to check if anyone had had a "careless driving" notice..

It was definitely only speeding as there were no red lights around and it is mentionned in the second letter (the non registered letter) that is was speeding: 78 in a 70 zone..

I'd be curious to know the outcome...


I got busted for 66 in a 50 zone so I just assumed it was 3 points off, but of course they never tell you in the letter. You have to look up the penalty yourself.
