The circumstances will dictate: importantly there may be details of how the parties have undertaken to leave HK in a court order. Even if one party gets the sole care and control of the child, the other party in usual circumstances still be granted reasonable access to visit the child. If the child moves out of the country, the other party may not have the chance to visit the child and therefore this reality must be taken into consideration.
