USA paying Social Security

ORIGINAL POST

Hello,

I am a US citizen and have been living overseas for 3 years. I am tax exempt as I am under the 90K USD and out of the country for 320 days of the year.

My question is should I be paying social security? Need to know if there will be any problems with the law when I go back. I have personal retirement funds but not paying to the government.

Appreciate any advice......

If you were an "employee" in HK, then you do not need to pay social security. I am not certain if you were self-employed. For now, SS is a payroll tax levied only on US income.

You do, however, have to file tax return every year, regardless of where you live or work. Even if your returns would result in zero payment, you still have to file.

If you did not file, then you need to contact the IRS and see how to remedy the situation. (there will be a fine, but no, they won't arrest you at the border. we are not that kind of a country, not yet anyway.)
