There's not much you can do without her knowledge short of seeing a solicitor to get some advice. If you get a divorce in HK save on any ground except 2 years separation you have to have the consent of the other party.


If you just send her the divorce petition that would be tantamount to 'ambushing her' and I don't think your solicitor would be very keen to do that. That kind of thing (whilst it does happen) is frowned upon. At the very least, you need to forewarn your spouse that you want a divorce and give her time to seek legal advice.


You need to discuss with her important issues such as custody of the children, division of assets etc. No divorce can proceed without agreement on these issues unless you are up for a protracted and very expensive bun-fight in Court.


Sorry - but divorce is one of the subjects you just have to face head on and come to as much agreement between yourselves on as possible.


Use lawyers just to do the paperwork and get everything signed off. Don't use them to start firing off curt letters which only make the situation worse and inflame an already bad situation.


If all else fails, consider a restraining order/non molestation against your spouse if you fear violence.


Would you consider separating and agreeing on joint custody? Divorce doesn't have to be so fast. Give yourselves time to work out what you both want and focus on your children. Lawyers can await. You are just an invoice to them.

It is impossible to obtain a divorce without your wife's knowledge. If there is an honest and genuine fear of child abuse or domestic violence, it will be better to seek help from police.
