Early termination of tenancy after 2 months we moved in

Hi, we just moved into a flat a month ago. On the second day we found a leaking problem caused by the washing machine, and water was soaking the wooden floor in a room directly next to it. We asked the landlord (who's a company) to send somebody to check and fix it. A contractor came by and a week later, they took the washing machine away for repair. Another week passed, they brought the washing machine back but the leakeage still occured, and the floor was getting worse. We asked them to check again and this time, they replaced it with another used and older washing machine. It did the job but we don't know when it will break down again.


In the past month, this has not been the only problem in the flat. Hot water tap needed fixing. One of the AC's is leaking. Issue with washing machine took almost 4 weeks to fix. And worst of all, the contractor and landlord representative speak very little English. And if further maintanence problems (complicated like the washing machine one) come up, it will be a pain for us.


We are considering to end the tenancy agreement early (we signed a 2 yr term) and was told to submit our letter of termination with one-month move-out notice. We want to request for some money back, at least our deposit. Does anybody know similar cases, with tenants breaking clause in second month of the their tenancy? Is there anything we need to be aware of? Will the landlord require us to make any additional payment or compensation to their loss? Any advice will help.

What does it say in your rental agreement? That should be starting place for finding the answers to your questions. If the issues are not dealt with in the agreement then you might or might not be able to fully achieve what you want to. Good luck.

In situations where I've broken the lease, I've offered to help find a replacement tenant for the landlord. This is to protect myself from losing one-month's deposit because the landlord will then have continuing rent and will not be short of income himself. Also, I was able to rent the flat for a slightly higher monthly rent, which I'm sure he was happy about, in which case I didn't have to pay the real estate agent's fee either.


Frankly speaking, the landlord has been fixing the items you mentioned. English-speaking skills is also no excuse for breaking a lease. If I were the landlord, I wouldn't be happy about your breaking the lease. I may lose more than one month's rent, as well as incur extra fees for a real estate agent to find a replacement.


Maybe you can find someone to act as a translator for you - if you offer to find a replacement, etc... then maybe your landlord is reasonable and you can come to some agreement about your deposit.
