Illegal worker causes problems

I believe in individual freedom. I am glad the HK police don't arbitrarily harass visitors. But I called the police on this foreign gentleman because he had been been violent and I wanted to press charges. They said I needed a witness, actually I can provide several.

I then requested the police to check his ID. They refused. Now, with all of the confidence in the world, he comes around and cause more problems for me and my family. If someone is here illegally causing problems--why won't the police take action and deport him?

I understand and agree. I am on the side of human rights. But this guy has done some terrible things and I would at least like to have a restraining order to keep him away.

DadyStyles, your post is very vague, to say the least. What exactly did this person do? You say he's an illegal worker; is he doing work for you? How do you know he's an illegal worker? You say he's violent and you want to press charges? What exactly has he done? Has he assaulted you? What are the so-called terrible things that he's done? What is your relationship with him? Then maybe you can get some better advice.

He is from India and sells clothes on the streets. He did not work for me. However, he was harassing a girl and I tried to help her. He then began to threaten me, told me he was going to "kill" me and so on. He then came with his friend to my apartment late at night. I called the police but they ran. There is more I could say about this person but this is a legal question not a factual one. As a matter of law, when can the police check someone's ID? Also, if they find he is working illegally, was happens? Will they deport him? In this instance, the person at issue is a terrible person and dangerous.

Sorry, but I still don't understand how someone selling clothes on the street knew where you lived and came to your apartment late at night. How did he know your addresss? "I called the police but they ran". That's quite unbelieaveable.

As a matter of law, the police can check someone's ID anytime they like. Everyone in HK is required by law to carry their ID card with them at all times.

If he is working illegally, he wil be charged and prosecuted, may be sent to prison and possibly deported.

These guy hung around near where I used to live. We all know that there are many people working illegally in HK. For the most part, the police do not bother with them. If they have a tourist visa, I assume they simply say they are here on vacation. Anyway, the point is that the police said unless they see him in the act there is nothing more I can do but file a report.

Under what circumstance will the police inspect his documents?

The police can inspect documentation if the person is acting suspiciously, or sometimes they just do routine checks.

Anyway, people on tourist visas are not allowed to work in Hong Kong. So if they're on a tourist visa and get caught working, they can't just say they're on vacation.

Maybe contact the Immigration Department rather than the police. They have a hotline if you want to report illegal workers.

Great idea. Thanks. BTW, one of them just hit a girl but she is too scared to call the police on her own. I am return to HK Thursday to deal with the police and immigration with her.

DadStyles, if they've hit a girl, that is assault and you should report it to the police and they have to look into it.
