Public area vs Private area

On #1, my guess is that the back deck area of IFC is not really public. It is owned by the MTR corporation like the rest of IFC. That being said, when MTR got construction permits those may have included clauses to keep certain areas available for the public.


On #3, the answer is no. For example outside IsoBar (Isola's upstairs bar) there is a large number of seats not belonging to the bar. While you may carry your drink out, the staff cannot force you to order. In fact, they won't even come out and take your order.

The outside balcony (upstairs) of in the Star Ferry pier used to be occupied by the Watermark restaurant, but now they have been told that this must be publicly accesable for non-customers and they have even had to put up signs stating this. I guess it is a big loss to them, because now they can not occupy this area anymore and anyone can just walk out there and block the view from the diners inside.
