I thought I'd throw this out there since I'm lost, but the situation goes as is.
My wife (6months pregnant) and I signed for an apartment that had a roof yesterday afternoon. To our surprise, the real estate agent tells us the same day, she discovered that the roof has a cellphone town on it with 9 radio wave emitting cellular boxes on the side. After investigating and knowing that radio/microwaves are harmful to newborns, I quickly told the real estate agent to tell the landlord that we no longer wanted the apartment due to the precaution of my soon to be born child. I also told her that it was never made aware to us as tenants. Thus we should be allowed to get our deposit back. After the real estate agent spoke to the landlord, the landlord responded with the response, that she never asked and that the lease was signed, therefore she does not need to return the money and I also need to give her an additional 3 months of monies. We were told we were renting the apartment and the roof to now have the landlord tell us it was the apartment and the roof was for us to use, but isn't ours. So all the stories are changing.
Now my question is, do we have a right to get out money back and exit this contract because we were never made aware of the cellphone towers above us and also because we were told we rented the roof along with the apartment. The landlord is saying it is the agent's fault and is our fault saying she did not need to tell us about the towers unless we asked about it.
Any help would be great. Thanks ahead of time.
