Divorce petiton after bankruptcy

My husband left me and my children last year. He wanted a divorce. He then filed for bankruptcy. He abandoned his children under my care without any financial support. I had been a homemaker since we had kids. Now, I cannot get back to work (I am still trying to find a job though) and I am using whatever is left of my savings for me and my children to survive.


I asked him repeatedly to send some financial assistance, but he keeps saying he is bankrupt. Now he is pushing for the divorce and tells me that I will not get anything from him because he has nothing to give.


If I contest the divorce, he can wait for 2 years so he can push through with it without my consent. Is this correct?

I want to know if I have any legal rights regarding the matter. What steps can I make shake him up? Can I file for abandonment? What is the law in Hongkong regarding child/children maintenance from a bankrupt parent?


I wish I can go to a lawyer to get some legal advice, however, considering my present financial situation, I cannot afford it. Hence, this legal advice forum. Please help.

Thanks beancurd. I have come across this website earlier today. I have given them a call and will set an appointment tomorrow. However, the guy on the other line said that it would take around 6 to 8 weeks waiting time before I could be accommodated for an appointment. Well, I hope they can take my matter as urgent and get to it right away.

just remember, legal aid is not free and whatever settlement you will get - part of it will be paying the legal help that you got. it is just like a loan. please send me a message and i will be able maybe to help you more.
