I replied to an ad on asiaexpat selling furniture. I visited the lady and gave her a deposit for the artwork and furniture I bought, coming the following week to pick up the items. She did not show on the first appointment and in the meantime she changed her mind on the items she was sellling. As I was busy moving I asked her to destroy the cheque as I was not buying anything. I trusted her but she cashed it ! I e-mailed and texted her and she says she has nothing to say to me. I threaten her to fill in a claim but she does not care. What can I do to have my money back (3.200 HK$) Thanks

You may then take out a small claim action in the Small Claims Tribunal (for a debt involving HK$50,000 or less). The Small Claims Tribunal is at 4/F Wanchai Tower, 12 Harbour Road, Hong Kong, tel : 2877-4068, fax : 2587-9139 / 2877-0412, email : smallclaims@judiciary.gov.hk.

Thank you for your reply. For sure I will issue a claim. Are e-mails and the cheque copy provided by my bank (with her name added by her) enough to produce as evidence. How can I prove that I did not buy anything from her ? Thanks
