I have been recently threatened by a small service provider that I had agreed to work for once a week. I was unable to start or complete the job that they required me to do. And they have had to hire someone else. They are asking me to pay the difference between that new hired person and myself. And have threatened to take legal action. They are very unhappy that I have decided not to take on the job but no where in the contract does it state that I have to do this. I have been deemed medically unfit to carry on with the contract and told them (without disclosing the reason) one week before the job. I did ring to tell them that I was unable to make it on the first day because I was sick (then 3 days later when my doctor thought that I was not able to work told them I am unable to continue with them). I am covered by medical leave.
The manager has insisted that I carried on with the job because I had signed a contract and I can't terminate it without valid reason. I told him I was not obliged to and so I told the manager that I questioned the validity of the contract which was signed but not addressing me in my name as stated in my HKID card and there is a reference to another person whom I do not know. It was a cut and paste job. And the manager had forgotten to delete all references made to the previous person. I am also on medical leave - deemed unfit for work.
Is this contract valid? If a contract was signed but not in the correct name and mistakes were made in that contract, is the contract valid?
The manager is harassing me and his emails have triggered a serious medical condition. They were of threatening nature. I would like to seek retaliation/compensation against this manager/company. Does anyone know if this is possible in HK just like in the US? I am looking to sue the manager (who is the owner of the company) for my medical costs which are exorbitant!

forget sueing them. just ignore it and trash the contract/emails. nothing is going to happen
