Dear Everyone,
Hope all is going well. I am desperately seeking an advice.
My landlord had asked a lawyer to kick us out immediately.
This is because I owe him the rent for Oct and Nov 2010.
We have no lease agreement since 2002.
I have been renting the place since 1999.
He has got 3 months of security deposit.
Lawyer send a letter telling to commence proceedings and face to face meet if i have
a lawyer.
Hope you can help. Thanks

the law says that as long as you pay rent, you have a valid contract which extends itself by one month at a time.
as you didnt pay, i'd say you are in trouble

I thought I'd check, do you personally know the time frame by law?, if we opt to leave.
We will pay the 2 months by next week and landlord mentioned they might change their mind not to kick us out...
I have asked if we really have to meet his lawyer to settle he said just do our best
to pay.

if you have not paid, it takes pretty long to evict someone. maybe 3-4 months, i would guess.
but you should not go down that path. better pay and stay on good terms

There is no security of tenure in Hong Kong currently….. if you have no written lease agreement, the Landlord may serve you notice (if you pay rental on a monthly basis, the notice will be one month notice); the notice will specify when you should leave the premises.
