My daughter might have returned to HK to marry a guy from India who is already married. I know polygamy is not allowed in HK. I am thinking he fabricated the information on the marriage application. Maybe he filed a fake divorce decree. Is there any registry to confirm a HK marriage even exist? If the marriage was based upon misleading information is it void or voidable? How can one obtain this information? Is there a department I should be contacting? This guy has a terrible track record including serving hard time in India. I am obviously sad and concerned!

in the case of a party under the age of 21 - the name and address of the person consenting to the marriage, and also the capacity of this person (i.e. the relevant person or persons specified in the Third Schedule to the Marriage Ordinance). Proof of relationship with the relevant person(s) is required.
Also, I wonder if he complied with the divorce requirements:
Divorced person/widower or widow
In the case of a divorced person, proof of the dissolution of the former marriage by decree pronounced by a competent court is required; and before the marriage takes place, a sealed certified copy of the court's final decree must be produced to the Registrar.
If the divorce documents or death certificates are not written in English or Chinese, certified translations of such are required.
I am not in HK. I need to ask a friend to do this for me. Hence, I would appreciate any and all assistance. I am obviously very concerned. My daughter opted to forego university to marry this guy with a terrible track record.

i cant answer your questions, but can add that in hong kong, all marriages are gazetted for 14 days in order for people to raise their objections.

Sounds like you have a few issues - and for starters if you can show that your consent as a parent was not given then you should be asble to stop the whole thing. However, as part of the registration process your daughter's proof of age would need to have been submitted - and therefore the missing consent would have been raised. The Marriage Registry is administered by the Immigration Department, and they are usually very helpful. You might have some issues, though, if a totally unrelated party (your friend) tries to make the enquiries for you. You could do this yourself by emailing the Dept at the address given in its website. I have emailed them (as well as phoned and visited in person) several times over the years and they have always been prompt and helpful with their response.

i have emailed them but haven't received a response. The guy remains married to an Indian girl. I say "girl" because she was 14 when he married her. He misrepresented her age to the court, saying she was 18. So this is polygamy... It's a terrible mess. I am out of country. She won't communicate w me because I am against her bf. He also has the habit of hitting the girls he's with, and all f them! I am obviously in distress. I was hoping the HK authorities would get involved. But they have been slow to respond!

Fair question. I was already there when she previously returned to be with him. I am a single parent dealing w young children. Finances are also at issue. Trust me when I say that I wish I could be there right now! Also, if I came, she wouldn't exactly run up and give me hugs. At 19 she sees me as the guy interfering with her true love. But no father wants his daughter in a relationship with a married man who beats women and children. She belongs in school, not under his belt! I have made countless calls to the police but they move slowly. I want to annul the marriage and get her out of HK.

You say you want to annul the marriage. That suggests that the wedding has already taken place - true? If that's the case then you should be able to prove that it was an unauthorised (at best) or illegal (at worst) 'transaction'. If it is illegal you shouldn't expect the police to jump up and down to put this on the top of their pile of cases to investigate. As a parent you have every right to be concerned about your daughter. However, as a parent you also have to accept that your daughter is 19yo and able to make her own decisions in life. She seems to have chosen to go through with this, and if it in unauthorised ot illegal the long arm of the law will eventually catch up with them - both of them (and it's improtant to note that your daughter would be just as guilty at law as would be her partner). As already stated, there's probably not a lot you can do to promote your case from outside HK. Your personal circumstances are noted but don't change anything. Sometimes you just have to let go and allow your children to grow up - and learn from their mistakes. It's hard, but sometimes it's necessary. Good luck.

I appreciate your response and if this was a regular guy, I would support the marriage with open arms. But he has been to prison for attempted murder and over beating (a crime in India for beating someone to near death). He does drug, sell, can't return to India (here on UNHCR refugee status) because he will be arrested for child rape. He has also hurt my daughter and he and his friend are under investigation for human trafficking. He married a 14 year old in India and at age 27 has been with other children. He is sick, dangerous and demented. Hence, considering the foregoing, my responsibility is to do whatever I can to separate this monster from my teenager daughter. I love my daughter and I will NEVER accept her being physically hurt from ANY guy!

A bigamist is one who marries another person while still married to someone else. The daughter in this case has not committed bigamy. Yet another sterling example of why people in need of legal advice should contact a real lawyer.

He was charged and convicted of attempted murder and "over beating" in India. After serving time in prison, he was released and then married a 14 year old. After word got out that he lied on the marriage application and that would be charged criminally, under Indian, with child rape, he fled to HK and applied for UNHCR protection under its refugee status. Hence, he won't be extradited. There is already the element of human trafficking. His friend misrepresent to another innocent teenager to come to HK on the pretense of a job. But there was no position of employment, just this guys fist and his bed!
These are not nice people. They are expert at brainwashing young girls and then getting such girls to turn against everyone in their lives. Maybe for some today is a happy New Year!
