dodgy landlord

I have finally managed to move away from my landlord, who was not good at all.

Now he is not returning my deposit. Not because anything is wrong with the flat.

As far as I know he is legally bound to return the money one week after I moved out. He told me he was unable to and wanted to delay it by a week.

I said that I would like to be paid interest on the amount. He refused, saying he had "told me he was going to pay it late".

Well, he was "going to pay" on the 1st July. But so far, nothing. He's "been busy" and "hasn't got around to it"

He also did not pay to have the airconditioning fixed, so I had to fork out more than 2k for that. I still have the bill and feel I should add it to the final amount.

This is the man, btw, who, even though I only had to pay rent by the 15th of the month, would text me dilligently to "remind" me, when the rent was not in by the first or second of the month.

So my question is this... what percentage of interest is fair, and how to get him to pay what he owes me, plus the interest.

Should he pay for the repair to the worn out airconditioner?

Thanks in advance

Check the lease and see what it says. At least some of them have provisions for payment of interest on late payments which work both ways.

The lease should also specify who is responsible for the aircon unit. The most common arrangement I see is for the landlord to provide the aircon unit in good working order but for the tenant to be responsible for cleaning the filters.

Unless the amount is very large, your best option may be to bring a claim before the small claims tribunal.

Thanks guys. He finally showed up at 10 pm, demanding to "come down" to see him after I had just put on a whole mudpack etc etc etc. Anyway, short story, I got the full security refunded, no interest and no aircon.

And you're right, he doesn't have the money.
