URGENT-Termination of Employment Contract

ORIGINAL POST

I signed a employment contract for a firm on May and was supposed to assume duty on Sept. The contract stated that I need to pay to the firm for one month salary for failing to assume duty on Sept.

In my view, the contract does not valid yet and the firm does not get all the certificates and documents of me they required. I am asking for legal advise they if I need to pay for them?

Thank you very much!!!!!!!!

If you both signed the contract in May, the terms of the contract are valid. If you now are not starting with them in September as agreed and there is a clause in the contract, that you signed, saying that if you fail to start then you will pay them one month's salary, then that is what you should be doing because that is what you agreed to do.

However, if you fail to do pay them, they have to consider the costs of chasing you for the money versus the money they will eventually receive.

I suppose it is up to your consciense as to whether you do what you agree to, or whether you are comfortable to break your word.

Good luck.
