CAN MY LANDLORD WALK IN ANYTIME SHE WISHES

My landlord thinks that she can come over whenever it pleases her, unannounced. Recently she came over and used her key to let herself in when I was sleeping, the woman about gave me a heart attack. She did provide me with the excuse that she was simply checking on a maintenance issue. I think a phone call would have sufficed.


Today I get a text saying that she did not like where I had put the microwave because is didn't apply with the manufacture's standards. So, she was in my apartment when I wasn't there! UGH!


What are the Chinese laws (in Shanghai) concerning the landlord/tenant relationship? Can she come over whenever she feels like it and let herself in.

In Hong Kong, no. In Shanghai you are the mainland so laws don't really apply. The basic rule of thumb for a foreigner, assuming you are one, is to avoid trouble. Let it go but politely suggest to her that a phone call would be a good idea as you may be taking a bath. Failing that, always make sure you are naked at home.

Change the lock, but keep the old one to replace when you leave.

With the heat I like to walk around my apartment naked or close to, but have not felt comfortable doing so since I moved here because I am afraid she will walk in with her husband whenever she feels the urge. I would be mortified if that happened, so I have had to adjusted my habits!

I have already asked her if she would call before coming over. That went nowhere, in a two week period she came over three times unannounced. The woman is driving me crazy.

So, I am leaning more towards changing the locks (great suggestion), can I do that without any repercussion though? I know that the mainland leans towards the rights of the landlord, but I must have some rights. I pay rent! Does that count for nothing!

she cant enter in the law of mainland so stand tuff and think you paying not living free and if she do again you can call to local magistrate or police

I agree 110% and that is why I had the lock changed on the door and so far she has not said anything. Does that mean she has found a new tenant to occupy her time...that she thinks her key doesn't work and is too embarrassed to say anything... or that she is on vacation? I don't know and I don't care. Come what may, I am standing my ground! Hopefully, I will not need to ask for more advise because she takes action against me for breaking my contract and moving out on the grounds of "unreasonable landlord behavior". Keeping my fingers crossed.

After reading all replies we agree with inttendu that not only changing lock you should also have your rent agreement insured. Now for sure as per our experience your land lord won't disturb you unless she has issues related to rent or relevant to that. she was surely disturbing and she know that.
