HK residency status after separation?

If a man gets a job in HK, therefor having an employment visa and moves here with his family, then wants to separate and divorce his wife before 7 years has passed, how will this affect his wife's right to remain in HK?


Will her right to reside in HK be revoked as she is no longer his dependent or will it continue uninterrupted until she's been here 7 years and then she can have permanent residency as if they had been married all along?



Will she still be counted as his dependent if they are separated?


Will separation affect the attainment of PR status?

The best way to know the answer is go to the immigration department and ask.


First thing to do is look at your passport and see the expiry date of the dependent visa. You're legally entitled to stay in Hong Kong using that visa until expiry, even if you're separated legally. Then see if you can apply for ROA without the support of the husband who's got ROA or work visa.


If the wife gets a sponsor (a new husband - meaning new sponsor for dependent visa, or an employer - meaning a working visa for herself), then she can stay legally in HK.
