I was to open a retail store, and had already agreed the terms of a tenacy agreement with the landlord. I had hoped to open in Jan 2012, however, the landlord pushed for me to sign earlier (targeting for first rent payment in mid Nov). Whilst the landlord was in the process of drafting the tenancy agreement (supposedly 1 week but has now been 1 and a half weeks). I went ahead with the ordering of stock, arrangement of business accounts, franchise fees, advertising and licences, which was known to the landlord. However, the landlord is now breaking the verbal agreement as they have a 'better' rent offer. If I have record of the verbal agreement in the form of emails, can I make a case against the landlord?

Until it's signed there is nothing you can do. We had similar situation a couple of months back, and when we sat down with the landlord to sign contracts he had decided to double the rent expecting us to sign. We just walked away. Happened to another large, long term HK company I know also in recent months. Nothing you can do.

Normally I would not have been caught unaware, however, the landlord is a prominent community service association in Hong Kong. I am still waiting for them (the associations' board members) to get back to me. I guess I haven't really got anything to loose.....I can delay my order, but it's just such a waste of time and effort.... Really pissed off about this.

Lucky for me that I found an even better shop location for an even lower rent. Pity I had to go through all that hassle and disappointment.
