Can someone give advise here regarding getting back our rental deposit?
We have moved out after giving 2 months notice as in the contract. We gave notice on the 20.10.2011 and moved out 2 months later as contract stated.
The landlord lives in the States and therefore we had to wait until today (31.12.) to have the handover.
For the last month we stayed only 20 days, therefore we also only paid 20 days as we served 2 full months notice prior.
We have covered more than the contract asked us (12+2 months instead of 11+2 like in the contract).
Now at the handover, the landlord says that only full months notice are normal and that she would deduct the 11 days that we still she claims "owe" her from the deposit. To be clear, nothing of a full month notice is in the contract stated.
The amount we dispute about is small claims court, but since I saw in other threads that even if judge says, landlord has to pay, no kind of legal binding to actually enforce it. As we left the apartment in perfect state we would like our money back in full.
What is your take on it, appreciate any helping counsel. Thanks, M

Did you lease directly from the landlord, or through an agency? If its the later, what is their opinion?

Try the Small Claims Tribunal. I'm a landlord and as long as you have completed your two months you should get a full refund unless the flat has been damaged.
