hi, am in a situation thats looks grim. We are two expats from different countries working over here. Im on a dependant visa. Have kids, born here, but things not working out and may have to seperate. Can my partner just get up and leave and take the kids with her? Im afraid she may leave and take them with her. Do i have any rights to the kids and can i stop her taking them?

If your partner has a passport, and the children have passports, who's going to stop them from buying a plane ticket and flying out of HK?

[UPDATE] Please note that fee quotes stated in historic postings may be out-of-date.

If one parent wishes to take the children out of Hong Kong on a permanent basis, and the other parent does not agree an application will need to be made to the Court and the Judge will decide. The Judge will take into consideration the circumstances and arguments of each of the parties but ultimately the Judge will base his/her judgment on what would be in the best interest of the child(ren).

A party can represent him/herself in Court or can seek legal representation. Should you require legal assistance you may wish to contact us:
