Building is under reconstruction for over 6months (new elevators, carpark fix, external facade, etc.)
Sandust
Noise
Darkness
Bulgary
Fresh airless
All-in-One at my rented apt.
Police came suggested to leave curtains down as the upper floors had bulgary broken thro windows from the erected bamboo escafoldings.
Currently apt doesnt have any secure window bars or doors with double locks or so.
I work till 3am, sleep till 12pm.
Am I entitled to a Refund on Paid Rent? I need to sleep somewhere else at least 5 nights per week.
or
The best would be an early termination returning my security deposit
Afterall the apt is no longer a peaceful place.
Based on my readings off this forum, Hong Kong Landladies are pretty tough to negotiate with returning full deposits.
I need some advise please.

I may contact you soon. The landlady refused to refund/discount/early termination. A second Burglary just happened at 6:30-8 pm, the police came to check if i am okay. My apt definitely is on target as there is no securities whatsoever (one simple door lock).
Sleeping after 9am is not an option.
My friends who rented an apt under similar environments got a refund of 50% of their paid rent till the reconstruction is over.
Tenants are clients, consumes of a service provided by the landlord.
In a long run, the building is solely of the landlord's benefit.

irfaankhan and all:
we are attending a court hearing at the land tribunal soon. Is there any legal precedence that we can cite during the hearing that a tenant prevails even its very close to our case?
Your two cents is appreciated.
We as tenants must have some rights. Maybe we can share and support ?
