Help! The owners upstairs have ignored a legal warning letter to help resolve our water seepage problem. FEHD and the JO have determined that the seepage is from their fresh water supply. Our guest bathroom has been without electricity for over a year now - this is beyond frustrating. What can we do? Can anyone recommend a good lawyer? Loathe to take this to court, but believe that upstairs will continue to turn a blind eye otherwise. Thanks in advance for any advice.

Any lawyer should do. It may be best to go through them to stop emotions getting fraught. If you have FEHD and JO then that should be enough. I suppose they are afraid of you claiming damages. It might be a good idea idea to say - that for for neighbourly reasons - you would waive that right if the situation is resolved quickly.

We're most likely heading to the Small Claims Tribunal. Lawyer fees were climbing through the roof! Have a quote for the cost of repair, but is it possible to claim for work that has yet to be done? Don't see the point of doing the repairs if upstairs haven't fixed their seepage, and if we win the case then common sense would prompt upstairs to fix the seepage in order to avoid a repetition of being taken to the SCT, right? Here's hoping. Sigh...
Has anyone had experience of enforcing the Nuisance Order?

You should employ a lawyer to issue an demand letter to claim damages for the seepage problem (it will take only HK$2-3K). After the upstairs received the solicitors' letter, normally they will seek settlement with you.
