Unpaid parking rent = free car?

Hi all,


Got a strange one here, ive been renting out my parking space for the past 5 years to an expat who after 6 months was transferred to beijing. Every few months i have to remind him to pay the rent, as the car is still in my space, even though he doesnt live here.


I have just noticed he hasnt paid me since june, and i just went to see the car, and it hasnt been moved in 5 years. it is covered in dust, and im not sure what to do.


the last time the licence fee was paid was 2008. the car looks really nice inside, but the windscreen wipers are rusty, i have no idea if it runs or not. I dont have any keys...


The car is a 1995 audi, so cant be worth that much, but im not sure if he has abandoned it. Im not sure if at some point the car reverts to being mine, and if it was mine is it worth having it!


So from a legal standpoint, i have no forwarding address for him, he hasnt answered my emails, and i have a very dusty old car (that could be ok..).


Any thoughts?

Just tell the building management that a car has been dumped in your car park and you want it removed. If they ask questions, just tell them you don't know but it is most certinaly not yours.

Send him a letter and state if the car is not moved in 14 days you will have it removed and scraped, you may recover a few thousand parking fees from a scrapyard .

I don't believe Armadillo has the right to sell the vehicle. He'll probably have to go to the small claims tribunal

i don't think you can just sell the car, i'm guessing it will have to be auctioned off by the relevant government authorities after legal proceedings have been instituted and you can probably recover some of the money after it has been auctioned off

The Hong Kong Police Force is responsible for abandoned vehicles in the city.


You may report the abandonment online with the Vehicle Obstruction form. https://secure1.info.gov.hk/police/epol-forms/ComplaintVehicleObstruction.htm

thank you all for the response. initally i was also thinking that if i kept the car (legally of course) it might be good to have a car, but i think once i have paid to renovate it, and also deducted the 6 months rent from the tenant, then its really not worth me having this car at all.


ideally i want my rent money... as long as he is paying there is no issue.


We found the owner has moved to another country in South East Asia, and we have his email address and his work address and his mobile number now. We are now trying to track him down. Hes ingoring emails, but we havent had a chance to phone him yet.


But Nutmeg, thank you, if we hear nothing, i think we will call the police and still try and get the 6 months rent from him... i just worry as he is living in another country it will be very hard to get him to pay us!

Any car that has been sitting idle for 5 years needs to be inspected by a decent mechanic before any attempt is made to start the engine, or move it (unless it is being scrapped).

Just an additional note. A car that has been off the road longer than 2 years is required to be re registered, that means a trip to To Kwa Wan to have a complete and thorough inspection at the transport department, not just a simple MOT.

intereseting, thanks for the info evildeeds. When i finally get a hold of him, thats another thing ill bring up! I dont want to just call the police because he owes me a lot of rent, which of course i want back.
