Going to Court

Hello,

A couple of months ago I reversed into a parked car, left my details etc and thought it was all settled through insurance. Police investigated for insurance payout reasons (the dent was the size of my hand). I admitted fault immediately but now I have been summoned to appear in court.

The problem is the court date I have been assigned is right in the middle of my 4 week holiday (Europe), have already paid for accomodation and flights for our whole family.

Has anybody had success changing a court date for a traffic offence? If not do you think a lawyer could represent me?

In your court documents there will be the name of the police officer in charge. Contact the police officer and explain to him your holiday plans (have all relevant proof ready).

I was in a similar situation for different reasons and never needed to go to court in the end but I was explained that I need to be prepared for costs associated with the delay.

Am not certain why the insurance route was not settled if it was a small accident. It is worth calling up your insurance company to investigate and understand. Also the police officer should be able to tell you. Good luck.

I am not a lawyer, but my understanding is that in HK the third party insurance will not pay out unless the police prosecute a party and a court has declared that party is guilty. For this reason many accidents are settled directly between owners in case of small damage to avoid the hassle.
