Driving offence

I was driving along Wanchai opposite the police station going towards North point after coming out of Wilson car park in Admiralty. I got pulled over by a police man on his bike and gave me a HK$450 fine plus 3points on my license for crossing a single white line. I am sure that I did not cross any white line but It's my word against the officer and dare not argue with him. Is there anyway I can prove that I did not do it without going to court? I don't mind paying the fine but 3 points too for something I didn't do is a bit harsh. Can anyone give me advice on this please! I'm having sleepless nights because of this.

According to the website of the HK Police Force (http://www.police.gov.hk/ppp_en/13_faqs/faq_tri.html#ts), you may file a complaint towards the issued fine in 3 ways when you find yourself being unfairly ticketed:

1. write to or personally attend Central Traffic Prosecution Division, 11/F, Arsenal House, No.1, Arsenal Street, Hong Kong;

2. call the hotline 2866 6552 during office hours; or

3. lodge the complaint through the e-Report Room. (website of HK Police Force e-Report Room - https://secure1.info.gov.hk/police/eforms/unjustified_issue_en.htm)


In addition you can attend court and ask the judge for an adjournment to allow you to contact the police to discuss the unfairness of the ticket.

Thank you very much Weir and Solicitors for your advice, i never had any free advice before. I will personally attend the Central Traffic Prosecution office as soon as possible. In the meantime should I pay the fine now or would it mean admitting to the offence if I did?

Once you are filing a complaint, the issue will go to the court. Being there, they'll tell you - and it is written on the ticket already - that you may end up paying the double fine!

Did that once with a parking ticket, showed pictures that my bike was not parking outside the box which is painted on the street, but rather on the line. My argument was, that in tennis the ball is considered inside when touching the line, the judge answered that parking is no tennis match.... I had to pay the double fine, but the judge released me from the 500 Dollar fee I otherwise had to pay additionally. In other words: No chance for you, the policeman is more trusted than you are.


Another thing: The 3 points are not added to your driving license, they are deducted from the original 15 points your driving license is coming with.... ;-)
