Fighting a parking ticket....

ORIGINAL POST

I found a parking ticket on my car yesterday in Stanley. It is dated "Dec 3" at 4:03 pm...yesterday was Dec 4 and the ticket was not on my car when i drove into Stanley. I can provide definitive proof that my car was in the parking garage at work (entirely different location) at 4:03 pm on Dec 3, and that it was in the parking garage at work until about 4:10pm yesterday.

How do I proceed? The number on the parking ticket to call takes me to an endless voicemail loop that actually ends by telling me if I have any questions. to call the same number again.

why you want to run away from your obligation. the fact is that you parked wrongly. be a man or and pay the fine as any others have to do.

Interesting statement, ling1234. OK, I'll pay a fine...just tell me exactly where and when this alleged offense occurred. Since a ticket obviously appeared on my windshield, then just tell me WHEN. If the officer cannot specify exactly when the alleged offense occurred, then anyone can just accuse anyone of a crime at any time, and your position is 'you must have done something wrong, just pay up."

If the TIME of the offense is wrong, how do you even know the LOCATION of the offense isn't also wrong? What evidence is there at all that an offense occurred other than the word of the officer who wrote the ticket....and as far as the time, I can prove without any doubt whatsoever that the 'word' of the officer is wrong.

It's a dangerous thing to assert that people are 'obligated' to self-incriminate and pay fines without being properly accused in a manner that is transparent and accurate.

Were you parked illegally in Stanley and the traffic warden wrote the wrong date?

OK, I have filled in the e-form stating that I was improperly ticketed. Do I still have to pay the fine using the info on the ticket, or is doing so an admission of guilt? Or do I wait the 21 days and get a notice of demand for payment. I don't want to do any missteps here.

OK, followup. (I am the same poster who was using the name 'riverman' previously)

I filed the e-form describing that that I felt I was improperly ticketed, but went ahead to pay the penalty to avoid facing future problems (as you may know, if you take it to court and lose, unpaid penalties are doubled).

Today, I got a notice from the Police that they are withdrawing the ticket, and refunding me the $320.

So the bottom line is: in this case, the police recognized that the ticket indicated a time and date where I could not have committed the traffic offense as stated.

So the process works....at least some of the time. :-)
