Dear all,

I'm a model from Europe and I have signed with a model agent in Hong Kong. Last year, I got a modelling job and I have not received the payment from the model agency. It is more than a year. I have contacted them. They just ignored my messages. Please kindly let me know what should I do and where can I get help to have my money back? Any legal advises? Thank you so much for your help!! I really need the payment before I leave Hong Kong.

Depending on the amount owed you may be able to make a claim in the Small Claims Tribunal, but that needs you to be present in HK.
Write to the Labour Dept of HK as they may be able to follow up as this may be a breach of employment contract; I presume you were given a contract and have a copy?
Copies of the documentation on the two actions above may persuade the agent to pay rather than fight a legal action.

Thank you so much for your advice. I don't think the modelling contract is an employment contract though, but I'm definitely apply the Small Claims Tribunal. Thanks again!!!

The Smalls Claims Tribunal is located in Wanchai North in one of the two buildings opposite HKCEC; I cant remember which tower it is. They are fairly helpful but the most important thing is to have the VERIFIED address of the agent; this may need you to do a company search for the registered address and cost a few dollars.
The modeling contract is still a contract for you to model (work) and Labour Dept may indeed look at it. It's best to attack from more than one position.

Thanks! Does the small claims tribunal charge? If it needs to go to the count, do I need a lawyer?

There may be a small processing fee of a couple of hundred dollars. No lawyer is necessary as the intent is to hear the claim without the need for expensive legal fees. Basically you prove they owe you money and haven't paid and the 'Judge' tells them to pay.
