Domestic helper and long service payment

My employer informed me today he will file bankrupcy over the next few weeks. So no severance pay will be made.

In case I can not find another position quickly I will need to make last whatever money my family can send from overseas (I am already personally with heavy debts and am a single mother of 2 with no help from the father )


Unfortunately i will probably not be able to keep our domestic helper and will need to break the contract.

She has been working over 5 years and should be receiving long service. However if I am without employment and in such a bad financial situation, are there some exemptions planned by the Labour Law?

Please no abuse, I am not trying to remove her rights from her but my kids must go first. When I have fallen back on my feet i will be happy to repay her for it even if it takes a while to do it.

Thank you for your reply Malka, but leaving Hong Kong is not an option as in my line of business I could bounce back pretty much only in Asia. Moreover my son is in the last years of IB and my daughter at Uni here, very difficult to relocate them.

Two things

1 your company if going under will make some compensation to you for ur hard and loyal service hope that's enough to settle urself for a few months

2. Regarding your dh u can release her due to ur financial situation and I think it's best u explain the situation to her now and work something out between the 2 of you
