Separating in Hong Kong

Hi fellow reader,


I am seeking some urgent advice. I have lived in hong kong now for just over 11 month. I came here with my husband and our two children however during the summer he decided that he no longer wanted to be married and has now given me divorce proceedings. It also turns out that he is trying to take my children and getting full custody for them.


My big question is my dependent visa runs out very very soon and he has told me that he will not renew it . What problems lies ahead for me? Can I get a visa without working here? Is he allowed to do this?


If anyone has any knowledge on this I would much appreciate it.

Get a good divorce lawyer. If your husband has money, then you should be protected by law.

Don't worry, you may report the matter to the Immigration Dept upon your renewal of the visa. Normally, your visa can be renew before the granting of divorce order by the court (it takes at least half an year!) without the guarantee of your husband since you have 2 children in Hong Kong.


After receipt of the divorce peitition from your husband's solicitors, you may get help from the Legal Aid Dept so that you can get lawyer to flight for the custody of your children. If you can prove that your are the right person to look after the children, you still have chance to get the custody of the children.

Best move is to take the kids to your home country, He can ultimately drag you back but you can argue that you had no right to work and no family support and no money.
