Hi,
I know someone who is "working" on a tourist visa in HK. She registered a company and sub-contracts herself out to clients through the company, the clients pay into her company bank account and she pays herself from there. She's been doing this for a couple of years apparently.
I nearly hired her to do some stuff for our company and then I found this out and immediately told her I need to look into it first.
My questions are:
1. is it actually illegal for her to do this, since she isn't technically being employed?
2. If we contract her company for services and she does the work, is our company doing something illegal too?

Technically, you will be off the hook if you do hire her and she's found out. But what she's doing is illegal (working in Hong Kong on a tourist visa. But maybe she's found a way to get a working visa already?).
