hi everyone,
Iam having problem with landlord. I rented a flat in central. everything was ok, suddenly there is some contruction going on our top floor & water leaking in our ceiling in bedrooms, i complaint to landlord. landlord said what can i do. its not my problem becuase upper floor got letter from housing deptt that he should do repair of his balcony. now iam having problem & i pay the rent for what. thats why i told landlord that till iam suffering i will not pay the rent from Feb 2010. my contract finish on 2nd May. now landlord send me Notice from land tribunal form 22.
PLEASE ADVISE. what can i do for my best & where should i go for complain or else.

first of all, pay the rent else you are in trouble
secondly, i would advise to go to the land tribunal yourself, but only if you have paid the rent

if you dont pay the rent, he can sue you and your are in default. anything that follows from there (i.e. you seeking a rent reduction, etc.), you will be on the wrong side of the fence in front of the lands tribunal.
given that your rent runs out, you might also simply chuck him the keys and refuse to pay. he can then sue you for the remainder (or simply take your deposit)

orangeman if i walk out after 2 months, he can file case against me & make lot of excuse that i damage lots of his property.
somebody suggest me to file case in court & let it go on without paying rent till the result come. it may take 5 to 7 months. so till this period i can stay there without paying rent. when it all finish you can move. In this case i can save my rent & live till court finalise. i will be staying here with no rent so who care if the case go longer or shorter this will be end atleast 2 or 3 months.. ...OR try to negotiate with landlord in land tribunal. what you guys suggest.

your last proposal is stupid, unfair and gives all tenants a bad name. don't do it please.
honest people pay rent for a living space. ok you had some problems, so let your landlord know. worst case, simply don't pay anymore from now on and let him know that he can use your deposit against your last two months rent.
then move on and don't get into legal battles. just costs you energy and stress and is simply not worth it

Put yourself in the landlords shoes. It's the responsibility of the landlord to fix what he can. In this case, it's the flat upstairs that is causing the problem. The landlords job is to push the owner upstairs to fix the problem as quickly as possible, not much else he can do. So why would you consider not paying him rent? It would be like arguing to the bank I won't pay my mortgage unless they fix the leak that's coming from upstairs. If you want to sue anybody then the owner of the flat upstairs is the one to sue.

cookie09 - I used to think like you, but I must say being honest also means you do get screwed by those who aren't. My previous landlord Lorea (she's a user here at asia xpat) has the record (and i have the emails to prove) of giving utmost hassle to return peoples deposit, which she never returns in full or at all. I didn't want to believe the rumours. But guess what? She's doing the same to me now. I'm warning everyone I can -- if your landlord is not trustworthy or have a reputation of not returning deposits....don't pay the last 2mos either. And my advice: stay away from any sort of business transaction with Lorea unless you're ready for some major headache.

Landlords I would avoid: lawyers, accountants and individual owners that only have 1 property that are stingy. You can already tell by how much free rent days they're willing to give you at the beginning of the month.
In my opinion it's better to rent from corporate (big or small), rich and well-off people as they wouldnt want to waste their time eyeing our little deposit.

If water damage is from upstairs, it is still there after upstairs fixes the leakage. Landlords should fix the damage to the room interior after the leakage stop or at least offer to assist to pay half. Electricity, Water, AC/Heat, they should fix.. on what grounds can they refuse? You pay the rent for functional apartments. This is common sense and common ethics which is why so many tenants did not even think about before signing the lease and had to find out the hard way when a problem first show up with the apartment. Landlords, if you are on this forum and you refuse to pay to fix electricity, water, heat/ac, and perhaps you knowingly hide your intentions to inform the tenants of this fact or perhaps you put in micro print in the lease that you will not be responsible for fixing problems or damages with the apartment.. then SHAME ON YOU! AND FOR THOSE WHO SIDES WITH THESE TYPE OF LANDORDS regardless of who they are, how rich they are, how corporate they are, than SHAME ON YOU TOO! FOR ANY PEOPLE LOOKING TO RENT, ASK YOUR LANDLORD TO SHOW YOU IN THE LEASE THAT HE/SHE WILL PAY TO FIX DAMAGES AND PROBLEMS. IF THEY CANNOT SHOW YOU, JUST WALK AWAY.

Ok, I really don't understand the fuss here. I am a Landlord AND a Tenant. Have a growing family so am renting a bigger flat while renting out my smaller property.
Shortly after moving in upstairs had problems with their pipes and a lot of water came into our bathroom. Caused some damage to my belongings, not to mention the hassle, but never did I thought of bitching to the landlord and demanding what they are going to do about it. Was it their problem, NO, it was upstairs fault. I called management, had them immediately go upstairs and get them to fix the problem.
Why would I even consider not paying rent because upstairs caused damage to my stuff?
Now if after the fact there is visible damage to the flat and the owner doesn't fix it then that may be a different story.
In your contracts it should clearly state what is and isn't covered. Don't expect every single thing is covered by the landlord.

I so agree with slimbouinhk..im a landlord and my tenants say some pipe burst and flooded the whole house and it needs new floors and pipe fixing..So we say yes and its gonna cost us 50,000 and it will take two weeks..all we want them to do is to find temporary place and when the flat is finish well give them 1month rent free..its not good enough for them they expect us to pay for that as well..they want to blame everything on us..i think theyre asking too much..so i said no if you want ill give your deposit back and move out permanently..and they said ok only if we pay their agency fee..am i wrong for saying no chance im gonna do that

My experience must be worst. I am renting a flat on Bonham Road in Hong Kong. (so ask me first before you sign a rental agreement for a flat on Bonham Road!). There are things breaking every month. Landlord refuse to repair or replace and claim those are not "structural", therefore not his responsibility. Most recently, I spent over HK$1500 to repair the water heater and MCB. Sighhh. (I live in Hong Kong)

Just for the record, I am a landlord but I was a tenant for 20 years. There are idiot landlords and crazy tenants. It would be better for some independent deposit system to be set up as it improves the level of trust. I have never not paid back a deposit - I look at flat like an aeroplane seat that needs to be filled and I understand wear and tear. I'm going to be misogynous now -- even though I have two daughters -- but I think women are worse landlords as they often get emotionally involved with the flat. Perhaps it's Darwinian.
