The situation I'm in at the moment is as follows:-
My wife and I moved into the apartment 9 months ago and from the second month in things started going wrong. Namely we went on holidays and then returned to a massive leak in the kitchen roof. It was promptly fixed only to start leaking again in a month. This time is took a full day for them to even come and look at the problem. Then the bathroom sink leaked and was fixed 2 days later. Throughout the tenancy the toilet water has been turned off by the building due to works, the longest period was 22 days in a row. 9 months into the 12 month contract and the toilet water has been turned off again. Supposedly for only a few days this time. I have asked to cancel contract with a definate no. I've asked for compensation and have been told no. She says it's a building problem not her problem. Also we have had an influx of fruit flies cochroches and we have found rat poo below the toilet exhaust fan frequently.
Please tell me what I can do to get out. What is the procedure to get out of the contract without losing money and if that's not possible, what happens if I refuse to leave and don't pay anymore rent?
How long does it take for them to evict me and does it go on my I.D. card record or can I get deported for it or what??

first of all, such problems as your describe are rather common in old buildings. and indeed if the building mgt turns off the water, there's nothing you can do against her.
to fix things within a few days is actually reasonably ok (just read these forums for reallly bad examples).
my suggestion would be to hold back the last two months of rent and stick it out for the 12 months.

Yes, I am interested n holding back the rent and what would be the consequences? How long before the landlord can take legal action? This concerns me too in a recent posting I made concerning disputes with landlord.

I seriously doubt that there is a "special list" for landlords only as I have many friends who are landlords and they know nothing of this list. Secondly, with the amount of paper work required to wipe your a** in Hong Kong, do you really expect me to believe that the eviction would happen "on the spot".... How could they prove you haven't paid and who would enforce an eviction claim by a landlord without a court ruling. Sounds like a landlord post to me Vita1234.

complete bs from vita. eviction takes 3-6 months after it has been proven that you are in default. and there's no "special list"

Very unfortunate circumstances but there is little you can do. As soon as you are able to give notice which I assume is after twelve months then you should do so. The landlord can take legal action and normally but check your lease after seven days of you with holding your rent. Eviction can be as quick at 4-6 weeks. Personally I don't think it worth the hassle, time and the expense involved. The law unfortunately is not on your side. The landlord though could with hold maintenance fees and deduct that from your rent as it does sound like a management problem.
Highly unlikely you could be evicted on the spot and there is not a blacklist for landlords to see. A complete fabrication by Vita.
