Hi, I just wanted advice regarding a good and fairly priced Matrimonial lawyer for my mom.
The situation is this: My mother and my father have been separated for 8 years, following my mother discovering his infidelity with a woman in China. In any case, after an awful year or two after the initial discovery, and after he was arrested in the US for domestic violence and bailed out by my mother (they were in the US with my younger siblings for a month or so), he left the household for good.
He used to pay maintenance for me and my younger siblings fairly regularly, up until two or three years ago. Now, he refuses to pay for the rent, and refuses to pay for my two younger sibling's school fees. He also refuses to fill in any 'financial help' forms that may ease his burden. This has ended in the absurd situation where my younger siblings may be kicked out of school despite the fact that we live in a fairly expensive part of town, and the fact that I go to university in the US.
In the past, he's violently rejected any notion of divorce. My mother will probably petition for one on the grounds of adultery, domestic violence and desertion.
Custody probably won't be a problem seeing as he hasn't made an effort in the past 6 or 7 years to contact his children, but we are completely dependent on him financially. How likely is it that maintenance will favor my mother? She's looking for full payment of the children's school fees, and maybe $20 000 HKD a month for herself.
How likely is it that she'll get this?
I'm just sick of this situation right now. I'd like for them to go their separate ways as soon as possible. Theirs is a very abusive relationship that still stresses my mom out everyday. Help please!
